Terms of Service

These Terms set the rules for using Alerta across Emergency SOS, Alert Mode, Safe Walk, automatic threat detection, location sharing, evidence capture, Guardian Mode, and institution-related workflows.

Effective date: March 1, 2026

1. Acceptance of these Terms

These Terms of Service govern your access to and use of Alerta, including the Alerta website, mobile app, dashboards, Guardian Mode features, institution-related workflows, and related services.

Alerta is a personal safety tool. It is not a replacement for 911, local emergency services, police, EMS, campus security, or any other emergency responder.

By using Alerta, you agree to these Terms.

2. Eligibility and authority

You may use Alerta only if you can legally enter into these Terms and your use complies with applicable law.

If you use Alerta on behalf of a school, employer, campus, or other organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts and access

You are responsible for keeping your account credentials secure and for the activity that occurs through your account.

You must provide accurate information and keep it up to date. We may suspend, restrict, or terminate access if we reasonably believe your account is being used unlawfully, abusively, deceptively, or in a way that creates safety, compliance, or security risk.

4. Emergency contacts and messaging consent

You may only add a person as an emergency contact if that person has explicitly agreed to receive Alerta safety and emergency alerts for you.

  • add a contact without that person's permission,
  • use a phone number or contact entry that you do not have the right to use,
  • add a contact from a purchased list, scraped source, or third-party marketing database, or
  • re-add a contact who has withdrawn consent unless that person agrees again.

Emergency contacts may receive transactional safety or emergency messages triggered by Alerta features. These messages are event-driven only. They are not marketing or promotional messages.

Certain automatic safety alerts may be sent by Alerta through backend providers such as Twilio and telecommunications carriers. Manual emergency messages and one-time Check-in messages are initiated through the user's own device SMS composer.

Standard message and data rates may apply, depending on the user's or the recipient's wireless plan.

For automated SMS alerts sent from Alerta's messaging number, recipients may reply STOP to stop future automated SMS from that number and HELP for support. Reply-based opt-out does not apply to manual messages sent directly from a user's device SMS composer.

5. Emergency-service disclaimer

Alerta does not provide emergency dispatch services and does not guarantee that any person, institution, or emergency contact will respond to an incident.

If you need immediate help, call 911 or your local emergency services directly.

6. Feature and delivery limitations

Safety features, alerts, recordings, live location, push notifications, SMS messages, timers, automatic detections, and incident updates may be delayed, filtered, inaccurate, incomplete, interrupted, or unavailable due to carrier or telecommunications issues, internet outages, device settings, battery constraints, operating system restrictions, permission settings, GPS limitations, microphone or sensor limitations, third-party outages, or other technical factors outside Alerta's control.

Carriers are not liable for delayed or undelivered messages. Automatic threat detection and similar features may produce false positives or fail to detect real events.

7. Prohibited conduct

You may not use Alerta to:

  • trigger false alerts,
  • harass, threaten, stalk, intimidate, or abuse any person,
  • impersonate another person,
  • monitor or track someone without authorization,
  • upload or share content that violates another person's rights,
  • send unlawful, abusive, or deceptive content,
  • interfere with the service or attempt unauthorized access, or
  • use Alerta in violation of law or these Terms.

You may not use Alerta for swatting, false emergency reporting, retaliation, domestic abuse, coercive control, or any other harmful misuse.

8. Evidence, recordings, and third-party privacy

If you use evidence capture, recording, photo, audio, video, or upload features, you are responsible for complying with applicable laws relating to privacy, consent, recording, surveillance, and evidence handling.

You must not upload or create content through Alerta unless you have the legal right to do so. Incident evidence may capture nearby people, voices, surroundings, or property during a safety event.

By submitting content to Alerta, you grant Alerta a limited right to host, store, reproduce, process, transmit, and display that content as needed to operate the service, document incidents, support authorized sharing, investigate misuse, and comply with law.

9. Guardian Mode and institution-related use

If you enable Guardian Mode, institution-related workflows, or incident sharing, you authorize Alerta to share the information needed to provide those features with the relevant guardians, administrators, or authorized responders designated through the service.

If your access to Alerta is provided through an institution or other organization, that institution may have separate policies, response procedures, and administrative controls that apply to your use.

10. Fees and charges

You are responsible for any charges your wireless carrier, internet provider, or device platform may apply in connection with your use of Alerta.

Emergency contacts and other recipients may also incur message or data charges depending on their own wireless plans.

11. Suspension and termination

We may suspend, restrict, or terminate your access to Alerta at any time if we reasonably believe that you violated these Terms, created compliance, fraud, abuse, or security risk, used the service unlawfully or harmfully, or exposed Alerta, its users, or others to legal or safety risk.

12. Intellectual property

Alerta and its software, design, branding, and related materials are protected by intellectual property laws. Except for the limited right to use Alerta under these Terms, no ownership rights are transferred to you.

13. Disclaimers

To the fullest extent permitted by law, Alerta is provided on an "as is" and "as available" basis.

We do not warrant that Alerta will prevent harm, that any safety event will be detected, that any contact or institution will respond, that any alert will be delivered or read, or that any evidence will be captured, uploaded, preserved, or accessible when needed.

14. Limitation of liability

To the fullest extent permitted by law, Siddharth Madhan and Alerta's service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, business, goodwill, or opportunity arising out of or related to Alerta.

To the fullest extent permitted by law, Alerta's total liability for claims arising out of or relating to the service will not exceed the greater of the amount you paid to Alerta in the 12 months before the event giving rise to the claim or CAD $100.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Governing law and venue

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or Alerta will be brought exclusively in the courts located in Kingston, Ontario, unless applicable law requires otherwise.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date and provide any notice required by law. Your continued use of Alerta after the updated Terms take effect means you accept the revised Terms.
